On the previous occasion this Court has passed following orders:-
"Heard learned counsel for the petitioner and Ms. Monika Arya, learned Standing Counsel for the respondents.
It is contended by learned counsel for the petitioner that the family pension of the petitioner was sanctioned on 3.1.2020 by respondent no.3 and the payment of the family pension is to be made by respondent no.2. Despite the fact that the family pension of the petitioner is being sanctioned, the respondent no.2 has not made payment of family pension to the petitioner, though a copy of the letter dated 3.1.2020 has also been sent to the respondent no.2.
Considering the facts and circumstances of the case, let respondent no.2-Additional Commissioner/Additional Registrar (Banking), Cooperative Societies, U.P. Lucknow be present before this Court and explain as to why the family pension of the petitioner is not paid despite the same has been sanctioned on 3.1.2020.
Put up as fresh on 7.1.2021."
Additional Commissioner/Additional Registrar (Banking) is present before the Court and it is stated on affidavit filed by him that a cheque of Rs.10,27,620/- has been issued to the petitioner. In para 9 it is averred that officer has joined only on 01.01.2021.
Learned counsel for the petitioner, on the other hand, submits that certain amounts are still outstanding and the entire amount has not been paid so far.
In view of the above, petitioner is permitted to approach respondent no.2 and indicate balance amount which remains outstanding alongwith copy of this order, within three weeks from today. The averment made in that regard would be got investigated by the authority concerned and any amount which is found due and payable to petitioner shall be released within a further period of two months, thereafter. It also goes without saying that regular pension etc. would be continued to be paid to petitioner from month to month.
Personal appearance of the officer concerned is dispensed with. Writ petition stands disposed of.
