Heard counsel for the parties and perused the record.
The present writ petition, inter alia, has been filed with the following prayer:
"(i) Issue a writ of mandamus commanding the respondents to pay the family pension, G.I.S. and gratuity to petitioner after the death of her husband on 20.2.2016, who died during his service tenure, who was working on the post of Assistant Teacher in Primary Vidyalay Karma, Block Gaur, District Basti."
The contention of the counsel for the petitioner is that the husband of the petitioner late Ramashankar Yadav died on 20.2.2016 while in service. After the death of husband of the petitioner, his son has been given compassionate appointment, however, family pension, gratuity/retiral dues for which the petitioner is eligible has not been paid to the petitioner till date. The petitioner filed representation to that effect before the Respondent No. 4 but the same has not yet been decided.
Considering the fact that the matter is pending consideration before the Respondent No. 2 and no decision has yet been taken, the petitioner is granted liberty to file a fresh representation before the Respondent No. 2 within a period of four weeks from today along with a copy of this order. In the event, any such representation is filed, the Respondent No. 2 shall pass order within a period of three months from the date of filing of the representation in accordance with law.
The writ petition is, accordingly, disposed off.
Copy of the order downloaded from the official website of this Court shall be treated as certified copy of this order.
