The applicant has invoked the jurisdiction of this Court under section 482 Cr.P.C. with a prayer to decide case No. 3714 of 2020, arising out of case crime no. 78 of 2015, charge sheet no. 177 of 2015, u/s 323, 504, 506, 498-A I.P.C. and 3/4 of D.P. Act P.S. Maharajganj, District Azamgarh pending in the court of Judicial Magistrate Fast Track Court (Mahila), Azamgarh within the stipulated period..
Learned counsel for the applicant has submitted that the applicant is wife of O.P.No.1, Learned counsel for the applicant has next submitted that the proceeding of the aforesaid case is pending since 2015 and has been lingering-on, on one pretext or the other.
In view of above, court below is expected to make all endeavour to decide the aforesaid case expeditiously preferably within a period of one year after giving opportunity of hearing to both the sides and without giving unnecessary adjournments to either side and there is no other legal impediment in deciding the aforesaid case.
With these observations, the application filed u/s 482 Cr.P.C. stands disposed of.
