Heard learned counsel for the petitioner and Shri Pradeep Kumar Tiwari for the contesting respondent nos.2, 3 and 4.
The instant writ petition is directed against an order dated 25.09.2018 passed by the Deputy Director of Consolidation on an application for stay filed by the respondents. Thereby, operation of the order impugned before the revisional Court has been stayed, the lower Court records have been summoned and the parties directed to appear on October 2018 for hearing of the revision on its merits.
In my considered opinion, the order of admission is a discretionary order. The revision filed by the opposite party has been admitted and an interim order has been granted thereon. Without appearing in the revision, the petitioner, who is opposite party in the revision has rushed to this Court by means of this writ petition.
The writ petition under the circumstances is not liable to be entertained. The petitioner may appear in the revision and make his submissions, whereupon, the matter shall be decided on its merits.
Subject to the above, this writ petition is dismissed.
