Heard learned counsel for petitioner and learned standing counsel for State-respondents.
Learned standing counsel has raised preliminary objection that petition is not maintainable as it has been filed for cancellation of election of respondent No. 4 who has been elected as Gram Pradhan for which remedy lies under Section 12(C) of U.P. Panchayat Raj Act, 1947.
Learned counsel for the petitioner could not dispute aforesaid legal submissions made by learned standing counsel.
Accordingly, writ petition is dismissed on the ground of alternative remedy with liberty to the petitioner to file election petition, if so advised.
