JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule. Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to attend the engagement ceremony of his brother.
It appears from the jail report that the convict was recently released on furlough leave from 4.8.2011 to 17.8.2011 and prior thereto, he was released for 37 days for his own treatment. Further, the ground is not such where his presence can be said as indispensable.
Under the circumstances, the discretion does not deserve to be exercised. Therefore, the application is not granted. Rule discharged.
