JUDGMENT / ORDER

Petitioner challenges Ext.P5, an order issued by the Village Officer calling upon the petitioner to stop digging the well in the petitioner’s property. According to the petitioner, he has valid permission by way of Ext.P3 from the Ground Water Authority to dig the well upto a depth of 8 meters. While so, Ext.P5 came to be issued by the Village Officer.
2. A perusal of Ext.P5 indicates that stop memo was issued by the Village Officer since the petitioner had used explosive substances for digging the well by blasting the rocks. If the petitioner wants to dig the well by blasting the rocks, necessarily the petitioner has to obtain permission from other statutory authorities to use explosive substance for blasting the rocks.
3. Under these circumstances, I am of the view that the petitioner is not entitled to challenge Ext.P5 and the W.P.C.No.13254/2014 2 Village Officer was justified in issuing the stop memo. Needless to state that the petitioner can proceed with the construction of the well only if the petitioner obtains necessary permission for using explosive substance for blasting the rock to enable the petitioner to complete construction of the well.
With the above observations, this writ petition is dismissed.
