Heard learned counsel for the petitioner and learned Standing Counsel for the respondents No.1 and 2.
In view of the order proposed to be passed, notices need not to be issued to the private respondent.
The petitioner is before this Court for a direction to respondent no.2/Settlement Officer of Consolidation, Mau to decide the Appeal No.512/624 of 2004 (Vimal Vs. Ram Chander and others) under Section 11(1) of Land Holding Act expeditiously within a stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the no.2/Settlement Officer of Consolidation, Mau to consider and decide the aforesaid appeal in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
