Sri Ajay Sengar, learned counsel for the applicant and Sri M.K.Singh, learned AGA for the State are present.
After some arguments, learned counsel for the applicant submits that cognizance has been taken by the Chief Judicial Magistrate, Jalaun on 23.7.2018 but the applicant has not challenged the order taking cognizance and therefore, he seeks permission to withdraw the present application with liberty to file a fresh application challenging the order of taking cognizance dated 23.7.2018.
As prayed, the present application under section 482 Cr.P.C. is dismissed as withdrawn with the liberty to file a fresh application in accordance with law.
