The petitioner is the accused in Crime No.166/2014 of Meenangadi Police Station, Wayanad District. Offences alleged are under sections 366, 328 and 376(2)(k) of IPC, Section 67 of I.T. Act and Section 119(b) of Kerala Police Act.
2. The petitioner has been in custody since 30.03.2014.
3. The allegation is that in 2011, August the accused raped the defacto complainant after giving some drugs and making her unconscious. He took nude photographs and thereafter by threatening that it would be published, he had sexual intercourse with her. It is alleged that later the nude photographs of the victim were published in the facebook of her brother, friends and so many other persons as B.A. No. 3249/2014 -2-
mentioned in the report. It is too cruel indeed.
4. The prosecution contends that the accused is a powerful person who would interfere in the course of investigation and would also indulge in similar criminal activity and that he would tamper with evidence and threaten or terrorise the witnesses. Considering the gravity of the offence, I am not inclined to grant bail to the petitioner at this stage. This application is hence dismissed.
