Heard learned counsel for the petitioner and Mr. Kapil Dev Singh Rathore, who appears for the respondents.
It is the grievance of the petitioner that his late mother was working with the Corporation on the post of mali since 1987 and she retired on 31.03.2012. She was getting pension and gratuity also but the leave encashment dues remained unpaid. She made several representations but they were not headed. The mother of the petitioner namely Raj Rani, thereafter, died on 12.11.2017. The petitioner is a sole dependent and he has repeatedly approached the respondents for release of leave encashment dues of his mother. The Executive Engineer wrote a letter to the Deputy Chief Accounts Officer on 30.05.2018 in this regard also. A copy of the letter dated 30.05.2018 has been filed as Annexure-10 to the writ petition. Till date the leave encashment dues of the late mother of the petitioner has not been paid.
The writ petition is disposed of with a direction to the respondent No.2 to look into the grievance of the petitioner as raised in his representation dated 23.05.2018 has forwarded by the Executive Engineer and pass appropriate reasoned and speaking order in accordance with law within a period of two months from the date a certified copy of this order is produced before him.
