The grievance of the petitioner is that the application filed under Order IX Rule 13 of the C.P.C. by him for recalling of the ex parte decree passed on 11.5.1993 was not be decided.
The application for recalling the order dated 11.5.1993 which was filed in the year 2001 could not be lingered for such a long time.
Under such circumstances, it is being directed that the application filed under Order IX Rule 13 of the C.P.C. being Application No. 211 of 2001 filed in Suit No. 150 of 1991 be decided within a period of three months from the date of presentation of a certified copy of this order.
The writ petition is disposed of.
