By means of the present application, the prayer sought is to quash the proceeding of charge sheet as well as cognizance order dated 13.04.2021 in S.S.T. No.766 of 2021(State vs. Vimal Kumar Rai) arising out of case crime no.217 of 2019 under section 419, 420, 467, 468, 471, 120-B IPC and Section 13(1)(d) read with 13(2) of Prevention of Corruption Act, police station-Rudrapur, District-Deoria pending before learned Special Judge(A/C) Court No.5, Gorakhpur.
I am not inclined to exercise my discretionary power in favour of the applicant.
Accordingly, the present application stands dismissed as such.
The applicant, if so advised, may move discharge application and the same shall be decided strictly in accordance with law.
