Sri Man Mohan Singh, learned counsel for the petitioner, learned Standing Counsel for State-respondents and Sri Pranjal Mehrotra, learned counsel for the respondent no. 5.
Grievance of the petitioner is that respondent no. 5 is not issuing NOC in his favour as a result of which vehicle in question being Registration No. UP63AT5130 is not in a position to ply.
On instructions, learned counsel for respondent no. 5 submits that as on date, the petitioner is required to pay Rs. 3,44,236/- and unless the said amount is cleared, NOC cannot be issued.
Learned counsel for the petitioner submits that he would clear the entire dues of Rs. 3,44,236/- till February 2022 and will continue to pay the future installments and upon doing so, respondent no. 5 be directed to issue NOC in his favour.
The above proposition has been accepted by respondent no. 5.
In view of above, the petition is disposed of permitting the petitioner to deposit the entire dues till February 2022 and upon doing so the respondent no. 5 may immediately issue NOC to the petitioner. It is made clear that the amount already deposited by the petitioner shall be adjusted accordingly.
