Heard Sri Vinay Saran, learned counsel for the petitioner and learned AGA for the State of U.P.
The writ petition has been filed for quashing the FIR dated 28.12.2018 registered as Case Crime No. 662 of 2018 under Sections 188, 291, 420 IPC, PS- Sadar Bazar, District- Meerut.
In the FIR in substance the allegation has been made that on 28.12.2018, when the informant Sub-Inspector Pramod Kumar was on his police duty then the accused was promoting about his musical programme by selling ticket scheduled to be on 4.1.2019. Although permission to hold the musical programme has been sought by the accused and it has been rejected by the District Magistrate on 27.12.2018. Thus, he was cheating with the people.
The learned counsel for the petitioner submits that there is no person who alleged that any ticket has been sold to him by the petitioner. The allegation against the petitioner in the FIR, is false.
In the facts of the case, this writ petition is disposed of with a direction that petitioners shall not be arrested in Case Crime No. 662 of 2018 under Sections 188, 291, 420 IPC, PS- Sadar Bazar, District- Meerut till the submission of police report under Section 173(2) Cr.P.C. The petitioner shall cooperate with the police during investigation.
