And 2 Others Counsel for Petitioner :- Shivendu Ojha,Radha Kant Ojha (Senior Adv) Counsel for Respondent :- C.S.C.,Arun Kumar
Hon'ble Govind Mathur,Chief Justice Hon'ble Saurabh Shyam Shamshery,J.
This petition for writ is preferred to have an appropriate writ order or direction for appointment of English Teachers at the District Basic Schools English Medium designated in the District of Prayagraj, Uttar Pradesh.
The petitioners in Village Education Committee constituted under the Act of 1972 and certain other persons have approached this Court with submission that English Medium School Teachers are required to be appointed as per the Scheme introduced by the State of U.P.. It is also brought to our notice that process of selection has already been completed and some of the persons selected have already given appointment in various schools but that process of appointment has not been completed in a huge number of schools in the District. In the petition for writ, no details have been given by petitioners no. 3 to 8 as to how they are concerned with the cause.
So far as, the Village Education Committee is concerned, it is a Statutory Body created under the Uttar Pradesh Basic Education Act, 1972. It would be appropriate for the Committee to agitate the cause before the Executive Authorities instead of approaching this Court under Article 226 of the Constitution of India.
In view of the above, the writ petition is disposed of keeping petitioner no.1 at liberty to agitate the cause before competent authority of the State Government. If petitioner no.1 agitates such cause before the concerned authority, the same shall be considered and decided, expeditiously, in accordance with law.
