Heard Shri Bhuvnesh Kumar holding brief of Shri Amit Srivastava, learned counsel for the petitioner.
This petition has been filed for a direction to the Principal Judge, Family Court, Agra to hear and decide the marriage petition being Case No.459 of 2017 expeditiously.
It is the contention of the learned counsel for the petitioner that an application under Section 13 of the Hindu Marriage Act was filed on 16 March 2017 seeking a decree for dissolution of the marriage between the petitioner and the defendant-respondent. While referring to the order-sheet of the court below, the learned counsel has stated that repeated dates are being fixed in the court below but the case is not being proceeded with.
A perusal of the order-sheet reveals that court below had fixed 9 February 2018 as the date for evidence in the case. However, thereafter the matter is being adjourned. An application under Section 24 of the Act is also pending consideration.
Considering the facts and circumstances of the case, it is directed that the court below shall endeavour to decide the aforesaid case pending before it in accordance with law, as expeditiously as possible, without granting unnecessarily adjournments to either of the parties.
With the aforesaid observation, the writ petition is disposed of.
