(PER : HONOURABLE THE CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) It appears that by order dated 3rd August, 2011, a Division Bench of this Court directed that pendency of this application will not stand in the way of the respondents in taking appropriate inquiry and to locate the person responsible.
Mr.
Munshaw, the learned advocate appearing on behalf of the respondent No.4 has drawn our attention to the fact that notice has already been issued. In such circumstances, we direct Mr. Munshaw s client to conclude the inquiry positively by 15th January, 2013. The Mamlatdar, in the meantime, will also recover the amount from the person responsible as reflected from the order dated 27th February, 2012 at page No.159 of the paper book.
Let the matter appear on 17th January, 2013. On that day, the respondent No.4 will submit report as to whether the amount has been recovered or not.
