None present for the petitioner even as notice issued to him by virtue of order dated 22.3.2011 is stated to have been served upon him. No one is present for respondent no.2/1 to 2/4 or respondent no.3. Learned counsel, Ms.Mini Nair, appearing for respondent no.1 submitted that that respondent has also passed away and the petitioner has not taken necessary steps for bringing heirs of respondent no.1 on record. The matter was listed earlier on 17.1.2012 after service of notice upon the petitioner and hearing was adjourned to give chance to the petitioner and in the interest of justice as per order dated 17.1.2012. Under the circumstances, the petition is dismissed for default and Rule is discharged with no order as to costs.
