JUDGMENT / ORDER

Learned counsel for the petitioner contends that sofar as writ for issuance of certiorari in challenge to order of suspension dated 3rd November, 2003 is concerned, the same has been rendered infructuous so much as order of removal from service has been passed. However, the petitioner has not been paid any subsistence allowance for the period of suspension and, therefore, this writ petition survives in regard to prayer no.2. A writ, order or direction in the nature of mandamus may be issued to the opposite parties to pay allowances for the period of suspension.
Arguing counsel for the respondent is not available.

No further adjournment would be given.
In case, counsel for the respondent does not appear on the adjourned date, the writ petition be decided on the basis of pleadings.
