Vide order dated 04.10.2010 the petitioner has been dismissed from service. Copy of the order has been furnished in court, which is taken on record. Learned counsel for the petitioner contends that against the order of dismissal, departmental statutory appeal has already been filed. In view of this later development, this writ petition is disposed of, however, with liberty to the petitioner that in case any adverse order is passed against him, he may approach this court at appropriate stage. Petitioner would also be at liberty to press his claim for release of subsistence allowance before the appellate authority, where the appeal is already pending.
