1. Heard Sri M.K. Khan, Advocate holding brief of Sri R.R. Shukla, learned counsel for applicant and learned A.G.A. for State of U.P.
2. Applicant has invoked inherent jurisdiction of this Court under Section 482 of Code of Criminal Procedure, 1973 (hereinafter referred to as "Cr.P.C.") with a prayer to quash order dated 25.05.2004 passed by Additional Chief Judicial Magistrate, Court No. 2, Allahabad in Sessions Trial No. 2470 of 2000.

Applicant moved an application for cancellation of proceedings initiated on an application filed by complainant under Section 156(3) Cr.P.C. for registration of FIR under Sections 307, 308 IPC which was registered as Case Crime No. 311 of 1994 but said application has been rejected by Court below. At the stage of registration of FIR, accused does not come into the picture and, therefore, Magistrate concerned has rightly rejected the application of applicant.
4. Application lacks merit and is accordingly dismissed.
