An order dated 28.8.2018, passed by District Inspector of Schools, Ghaziabad is assailed in this petition whereby benefit of lecturer's post granted to the petitioner w.e.f. 18.12.2010 has been unilaterally recalled. The order is assailed on various grounds including the ground that no opportunity of hearing was afforded to the petitioner before passing the order itself. It is also stated that in terms of the applicable Government Orders petitioner was entitled to such benefit and there is no justification on merits also for withdrawing the benefit already granted.
Learned Standing Counsel on the basis of materials brought on record does not dispute the fact that opportunity of hearing has not been given to the petitioner.
In view of the fact that the order impugned carries civil consequences and opportunity of hearing has been denied to the petitioner, as such the order dated 28.8.2018 cannot be sustained and stands quashed. It shall be open for the respondents to afford an opportunity of hearing to the petitioner and after considering his explanation, proceed further by passing a fresh order, in accordance with law.
Writ petition stands disposed of.
