This petition is directed against a show cause notice dated 20.7.2018 which calls upon the petitioner to submit his reply on the question regarding his continuance as Home Guard on the ground that a criminal case is pending against him. Petitioner has also been suspended from duty in the meantime.
It appears that though petitioner has submitted a reply to the show cause notice, but a final decision has not been taken. Since the notice under challenge merely accords an opportunity to the petitioner to submit his response and has otherwise been issued by the competent authority, no interference with it is required in exercise of writ jurisdiction. Challenge laid to the notice impugned, therefore, fails.
It is, however, provided that petitioner's reply submitted to the aforesaid notice would be considered and an appropriate order would be passed by respondent no.4, in accordance with law, within a period of two months from the date of presentation of certified copy of this order.
With the aforesaid observations, this writ petition is consigned to records.
