Heard Sri Tarun Kumar Tripathi, learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1 to 3 and perused the record.
Instant writ petition has been filed by the petitioner seeking a mandamus commanding Board of Revenue, U.P. at Lucknow (respondent no.2)for early disposal of Reference No.159 (LR) of 1995-96 (Vikram Singh vs. Rajaram) in the Court of Board of Revenue, U.P. at Lucknow.
It is submitted that in a proceeding u/s 34 of the U.P. Land Revenue Act, 1901, Tehsildar has passed order dated 06.11.1992. Against the said order, appeal was filed u/s 210 of U.P. Land Revenue Act, 1901 before the Sub Divisional Officer, Mahoba, who has allowed the same vide order dated 04.01.1994. Against said order of S.D.O, revision has been preferred before the Commissioner, Jhansi who has allowed the same and made reference to the Board of Revenue vide order dated 15.07.1996. It is submitted that since order dated 15.07.1996, reference made by the Commissioner is pending before the Board of Revenue, protracted without taking any fruitful step to decide the same finally on merits.
In this conspectus as above, no useful purpose would be served to keep the matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Board of Revenue, U.P. at Lucknow (respondent no.2) before whom Reference NO.159 (LR) OF 1995-96 is pending disposal, to decide the same expeditiously, preferably, within the period of six months from the date of receipt of copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad, supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court.
With the aforesaid observation, present writ petition is disposed of.
