Heard Mr. Ajay Kumar Dwivedi, learned counsel for the petitioners, Mr. Vivek Kumar Rai, learned counsel for the respondents-University and learned Standing Counsel for the State-respondents.
The Writ petition has been filed with the following prayer:-
"I. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 Dr. Bhimrao Ambedkar University, Agra to provide degree of Bachelor of Education (B.Ed.) 2012-13 in purusance of online applications of the petitioners forthwith."
Learned counsel for the petitioners submits that respondents- University has not issued the B.Ed degree of the petitioners for the session 2012-13. The petitioners have made their representation before respondents-University in this regard but nothing was done till date.
Mr. Vivek Kumar Rai, learned counsel for the respondents- University submits that the B.Ed examination for the relevant year came under a cloud and was investigated by an internal enquiry set up by the University.
Learned counsel for the respondents-University fairy submits that University is under an obligation of law to issue the B.Ed degree to all bonafide students and to provide reasons in case where the degree cannot be issued.
Considering the facts and circumstance of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction upon the petitioners to file a fresh representation/application, ventilating all their grievances, supported by such documents, as they may be advised, before the respondent no.2 Registrar, Dr. Bheem Rao Ambedkar University, Agra within two weeks from today along with a certified copy of this order. On receipt of the same, respondent no.2 shall place the same immediately before the Examination Committee of the University, which shall make all endeavours to consider and decide the same, keeping in mind the entire career of the petitioners, in accordance with law, preferably within a period of two months, from the date of production of certified copy of this order.
It is made clear that this Court has not examined the merits of the claim of the petitioner and the authority concerned shall apply its own mind strictly in accordance with law.
