Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This anticipatory bail application has been filed on behalf of the applicant seeking anticipatory bail in Case No. 600 of 2014, under Sections - 147, 148, 336, 452, 324, 323, 506 I.P.C., Police Station - Gajraula, District Amroha, pending in the court of Chief Judicial Magistrate, Amroha.
Upon perusal of the records, it transpires that interim protection/relief was granted by the co-ordinate Bench of this Court, which is now deemed to be operative till 5th August, 2021.
On 6th August, 2021, the applicant shall surrender before the court or the authority concerned, as the case may be. In case, he moves any regular bail application, then considering the gravity of the offence, the accusation and the punishment provided, if is within 7 years punishment, then the protection under Section - 41(1) Cr.P.C. shall be available to the applicant and the authority and court concerned may heed to the same and consider the regular bail application on merits.
With the aforesaid observation, this application stands disposed of.
Nothing has been observed on the merit of the case.
It is made clear that, if the applicant does not surrender before the court concerned, within the time prescribed by this Court, then due course of law would follow against the applicant.
