Heard learned counsel for the applicant, learned A.G.A. and perused the record.
It is submitted by learned counsel for the applicant that the co- accused Arun Kumar Bharti alias Arun Kumar Giri has already been granted bail in Case crime no.372 of 2008 by this Court on 1-12-2009 in Bail Application No.30566 of 2008. . It is further submitted that the case of the applicant stands on the same footing and claimed parity. He is in jail since 7-4-2008 and has got no other criminal history.
In view of the facts and circumstances of the case and submissions made by learned counsel for the applicant and learned A.G.A. and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Vikki Lal @ Ved Prakash Srivastava involved in Case crime no.372 of 2007 under section 147, 148, 149, 307, 120B IPC and Section 7 of U.P.Crl. Law Amendment Act, Police Station Kotwali district Ballia be released on bail on his on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
