Shri Satya Prakash Singh, learned counsel for the applicant and learned A.G.A. for the State and perused the material on record.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceeding of Case No.734 of 2021 (State Vs. Rijwan & others) arising out of Case Crime No.109 of 2021, under Sections 420 of Indian Penal Code and 15(2) 15(3) of Indian Medical Act, registered at Police Station- Dadri, District- Gautam Buddha Nagar as well as Charge Sheet No. 01 of 2021, pending in the court of 1st Additional Chief Judicial Magistrate, Gautam Budha Nagar, District Gautam Buddha Nagar and also cognizance/summoning order dated 16.04.2021.
Upon considering the facts and circumstances of the case, the prayer made by learned counsel for the applicants is hereby refused.
After some arguments, learned counsel for the applicant wants to withdraw the application with liberty to file a bail application before the court of competent jurisdiction.
In view of the above, the application is disposed of as withdrawn with liberty to the applicant to file an appropriate application for bail before the court below in terms of the decisions rendered by the Supreme Court in Satender Kumar Antil Vs. Central Bureau of Investigation & Another, Special Leave to Appeal (Crl.) No(s). 5191 of 2021 decided on 07.10.2021.
