Heard learned counsel for the applicant and learned AGA for the State.
The applicants are husband and father in law of opposite party no.2, a criminal complaint no. 278 of 2012 was initiated under Section 406, 504 and 506 IPC, P.S. Chaubepur, District Kanpur Nagar.
Keeping in view that present criminal prosecution is off shoot of the matrimonial discord between the parties. The matter was remitted to mediation Centre for settlement. From the record it transpires that the parties has entered into an interim settlement but unfortunately the scene could not be finally materialized and the proceedings of mediation was got aborted. The facts remains that it is a off shoot of matrimonial discord between the parties and the process of mediation has failed.
Learned counsel for the applicant has unable to point out any illegality in the impugned order and as such the present 482 Cr.P.C. application is devoid of merit and is accordingly dismissed.
However, keeping in view that :-
(i) Though the applicant are permitted to surrender before the court concerned.
(ii) The applicant no.2 is aged old person of 75 years, his bail application shall be heard and considered by the court below, if possible, on the same day and after getting himself bailed out, it is always open to the applicant to seek discharge in the matter.
With the aforesaid observation the present application is disposed of.
