Heard Mr. S.S.P. Gupta, learned counsel for the petitioner and Mr. Hari Nath Tripathi, learned counsel for the U.P. Pollution Control Board.
Counsel for the petitioner submits that the petitioner would be satisfied if directions are issued to the Regional Officer, U.P. Pollution Control Board, Region Ghaziabad to consider the petitioner's grievance as made in the applications dated 4.10.2016, 20.10.2016 and 15.01.2018. Counsel for the U.P. Pollution Control Board submits that if any such direction is issued, the Regional Officer shall consider the petitioner's grievance within time frame.
Hence, we dispose of this writ petition directing the Regional Officer of the U.P. Pollution Control Board, at Ghaziabad to consider and decide the petitioner's applications dated 4.10.2016, 20.10.2016 and 15.01.2018 after granting an opportunity of being heard to respondent no. 5 on merits in accordance with law as expeditiously as possible and preferably within a period of four weeks from the date of receipt of a copy of this order. It is made clear that we have not examined merits of the case. The petitioner is directed to produce a copy of this order along with a copy of writ petition and annexures before the Regional Officer of the U.P. Pollution Control Board at Ghaziabad within a period of two weeks from today.
