Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Ravi Prakash, learned counsel holding brief of Sri Vivek Kumar Rai, learned counsel for respondent University.
Present petition has been filed seeking a direction to respondent no. 4 to issue the marksheet and certificate of B.Ed. degree course for the session 2012-13 to the petitioner.
During course of argument, it transpired that some inquiry was going on in the matter of forged marksheet.
Learned counsel for the respondent University submitted that the inquiry is now complete and therefore grievance of the petitioner can be considered by respondent no. 4 on its own merits and for this purpose he may approach respondent no. 4.
Accordingly, the present writ petition is disposed of with liberty to the petitioner to file a detail representation along with self attested copy of the order before respondent no. 4. In the event any such representation is filed, respondent no. 4 shall consider and decide the same strictly in accordance with law keeping in mind the outcome of the inquiry, preferably within a period of one month from the date of production of self attested copy of the order, which may be verified from the official website of this Court.
It is made clear that this Court has not considered the claim of the petitioner on merits.
