The prayer made in the instant petition is for issuing direction to the trial court to decide Misc. Case No. 28/74 of 2015 filed by the petitioners seeking recall of ex parte order dated 19.10.2013 within a specified time frame.
According to the petitioners they were not impleaded in the suit and the plaintiffs succeeded in getting the suit decreed on 19.10.2013. The application filed by the petitioners under Order IX Rule 13 for setting aside the said decree is stated to be pending.
Having regard to the facts of the case, the instant petition is disposed of with direction to the trial court to decide Misc. Case No. 28/74 of 2015 expeditiously by fixing short dates and without granting unnecessary adjournments to either of the parties, provide there is no legal impediment.
