THE HON'BLE SRI JUSTICE L. NARASIMHA REDDY CIVIL REVISION PETITION No. 4102 OF 2014 ORDER:
The respondent is the wife of the petitioner. She filed O.P No. 898 of 2011 in the Court of Additional Family Judge, City Civil Court, Hyderabad for divorce against the petitioner. She has also filed I.A No. 190 of 2014 under Section 24 of the Hindu Marriage Act for interim maintenance at the rate of Rs.50,000/- per month and Rs.1,00,000/- towards legal expenses. The application was opposed by the petitioner. The trial Court passed order dated 19- 09-2014 granting interim maintenance at the rate of Rs.15,000/- per month and legal expenses at Rs.10,000/-. The said order is challenged in this revision.
Heard Sri P.V. Sanjeeva Rao, learned counsel for the petitioner and Sri T. Sharath, learned counsel for the respondent.
The petitioner contends that even the respondent is employed and at present, he is not drawing any salary. Though the learned counsel for the respondent admits that his client is working, he disputes the statement that the petitioner is not employed. Even if the petitioner is not earning any income, he is under obligation to maintain his wife. Taking into account the fact that the respondent is also drawing some income, this Court is of the view that maintenance can be fixed at Rs.10,000/- per month and legal expenses at Rs.5,000/-.
The C.R.P is accordingly disposed of. The miscellaneous petitions filed in this revision shall also stand disposed of. There shall be no order as to costs.
