Vikas Kumar vs Chairman Bank Of India And Others

High Court Of Judicature at Allahabad|27 April, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 18941 of 2004 Petitioner :- Vikas Kumar Respondent :- Chairman State Bank Of India And Others Counsel for Petitioner :- R.N. Yadav,P.K. Jaiswal Counsel for Respondent :- Vipin Sinha,S.C.,Satish Kishore Kakkar Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel as well as Sri S. K. Kakkar, Advocate are present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs :
"(i) To issue a writ, order or direction in the nature of writ of certiorari quashing the impugned orders dated 14.11.2002, 8.4.2003 as well as order dated 18.12.2003 issued by opposite party no.3 and 4 contained in Annexures No.1, 1-A and 1-B to the writ petition.
(ii) To issue a writ, order or direction in the nature of writ of certiorari to quash the direction issued by opposite party no.2 after summoning the same from opposite party no.2.
(iii) To issue a writ, order or direction in the nature of writ of mandamus commanding the opposite parties No.1 and 2 to re-consider the case of the petitioner for compassionate appointment as per scheme of the bank and give appointment as per qualification of the petitioner.
(iv) To issue any other writ, order or direction in favour of the petitioner which this Hon'ble Court may deem just and proper in the circumstances of the case."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
