Learned counsel for the petitioner is permitted to implead the Block Education Officer, Shergarh, Bareilly as respondent no.3 during the course of day.
Heard learned counsel for the petitioner, learned standing counsel for the respondent no.1 and Sri Pranesh Dutt Tripathi, learned counsel for the respondent nos. 2 & 3.
Learned counsel for the petitioner submitted that petitioner is challenging the impugned order dated 23.2.2019 passed by the respondent no.2 on different factual grounds.
Mr. P.N. Tripathi, learned counsel for the respondent nos. 2 & 3 has produced the instruction dated 19th September, 2019, which is taken on record. He further submitted that petitioner was served with the charge sheet dated 4th May, 2019 to submit reply, but he has not submitted any reply. Two reminders dated 20th July, 2019 and 19th September, 2019 have also been sent to petitioner for submitting the reply of charge sheet dated 4th May, 2019, but till date he has not submitted any reply. He next submitted that petitioner has also concealed the facts about the issuance of charge sheet as well as reminders dated 20th July, 2019 and 19th September, 2019. Therefore, no interference is required and this Court may please to dismiss the writ petition.
At this stage, learned counsel for the petitioner submitted that he shall submit the reply of charge sheet dated 4th May, 2019 within 10 days from today and direction may be issued to respondent no.3. to complete the enquiry.
Under such facts and circumstances, in case reply to the charge sheet dated 4th May, 2019 is submitted by the petitioner within 10 days, respondent no.3 is directed to complete the enquiry and submit the enquiry report maximum within six weeks thereafter. Respondent no.2 is also directed to pass final order within next two weeks from the date of receiving the enquiry report. Petitioner is directed to extent the full cooperation in completion of enquiry.
It is made clear that in case reply to the charge sheet dated 4th May, 2019 is not submitted by the petitioner, respondents are free to pass suitable order in accordance with law.
With the aforesaid observations, the writ petition is disposed of. Order Date :- 27.9.2019 Junaid
