The present petition has been preferred by Sri Vikas Dubey plaintiff-petitioner under Article 227 of the Constitution of India with the prayer to direct the Principal Judge, Family Court, Gautam Budh Nagar to decide the application filed by him under Section 12 of Guardians & Wards Act, 1890.
The aforesaid application was filed by the petitioner before the court below on 04.02.2020 in Misc. Case No. 09 of 2020 (Vikas Dubey vs. Deepti Dubey) with the prayer to permit the petitioner to meet with his child namely Apurv Dubey who is residing with his mother namely Deepti Dubey who is the wife of the petitioner.
It is further argued that large number of dates were fixed in the aforesaid matter but till date neither any order has been passed on the aforesaid application dated 04.02.2020 nor the decision has been taken in the case.
Heard counsel for the petitioner and perused the record.
Without entering into the merits of case, the present petition stands disposed of finally with a direction to the court below to pass appropriate order on the application dated 04.02.2020, copy of which is appended as Annexure-2 to the writ petition, in accordance with law most expeditiously and preferably within a period of thirty days from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
It is made clear that the court below will decide the entire case expeditiously and preferably within a period of four months thereafter.
