Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed to direct the learned District and Sessions Judge, Hapur to conclude/decide the trial in case no. 27882 of 2016 arising out of case crime no. 517 of 2013, under Section 65/66 Information Technology Act, P.S. Barra, District Kanpur Nagar.
The contention of the counsel for the applicant is that no offence against the applicant is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention. The matter is pending since the year 2016.
Keeping in view that the matter relates to the year 2016, I hereby direct the learned District and Sessions Judge, Hapur to gear up the matter and make necessary endeavour to conclude the trial expeditiously under the provision of Section 309 Cr.P.C. without granting unnecessary adjournment to either of the parties, if there is no legal impediment.
With the aforesaid directions, this 482 Cr.P.C. application is finally disposed of.
