Vikas And Anr. vs State Of U.P. Through Prin. Secy. ...

High Court Of Judicature at Allahabad|20 May, 2021

JUDGMENT / ORDER

Hon'ble Saurabh Lavania,J.
Heard learned counsel for the petitioners and learned A.G.A. for the State.
The petitioners herein seek issuance of a writ in the nature of Mandamus directing the respondents not to harass or interfere in their matrimonial life.
Contention of the learned counsel for the petitioners is that the petitioners have married each other of their own volition and on the date of marriage they had attained the age of majority. The have also annexed their marriage certificate issued by the Registrar (Marriage), Balrampur. High School marks-sheet of the petitioner no. 2 has also been annexed which shows her date of birth as 08.07.2019. Based on it it is said the she is major, however, Police is harassing the petitioners, as alleged, at the behest of family members, because this marriage is against their wishes.
In view of the above, it is provided that if the petitioners are not wanted in any other criminal case or there is no other valid ground in law, then the Police shall not unnecessarily harass them and interfere in their peaceful life. With these observations/directions this writ petition is disposed off.
It is made clear that we have not adjudicated the age of the petitioners nor the validity of their marriage.
