Heard learned counsel for the applicants, learned A.G.A. for the State and perused the material on record.
The present application under Section 482, Cr.P.C. has been filed by the applicants to quash the entire proceedings of S.S.T. No. 3971 of 2021, arising out of Case Crime No. 926 of 2020, under Sections 354, 452, 323, 504, 427, Indian Penal Code and Section 3(1)(Dha)(Bha) and 3(2)(v) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, Police Station Chakeri, District Kanpur Nagar, pending before the Special Judge, SC/ST Act, Kanpur Nagar as well as charge sheet dated 22.3.2021 and cognizance order dated 22.6.2021.
Upon considering the facts and circumstances of the case, the prayer made by learned counsel for the applicants is, hereby, refused.
After some arguments, learned counsel for the applicants wants to withdraw the application with liberty to file bail application/discharge application before the court of competent jurisdiction.
In view of the above, the application is disposed of as withdrawn with liberty to the applicants to file bail application/discharge application before the court below and the court below is directed to decide the aforesaid application in accordance with law, as expeditiously as possible.
