While entertaining this petition, following orders were passed on 27.06.2018:-
"Learned counsel for the petitioner submits that he has raised objections regarding three questions being question no. 20, 24 and 31 and out of which his objection regarding question no. 24 has already been decided but no decision has been taken on question nos. 20 and 31.
Sri Vikram Bahadur Yadav, learned Standing Counsel prays for and is granted 15 days time to seek instructions in the matter.
Put up this case as fresh on 16.7.2018 before the appropriate Bench."
Learned standing counsel has obtained instructions, copy of which has been furnished to the counsel for the petitioner. According to the instructions, question nos. 20 and 31 contain incorrect answers and therefore, marks have been normalized and have been extended to all candidates who have attempted the said questions. According to the respondents, appropriate marks for these two questions have been given to the petitioner.
Submission of respondents is opposed by the counsel for the petitioner, who submits that no marks have been given to the petitioner in respect of question nos. 20 and 31.
Whether petitioner has been given marks in these two questions or not is a matter which can more appropriately be examined by the competent authority, at the first instance.
This petition, therefore, stands disposed of permitting the petitioner to approach respondent no. 3, along with certified copy of this order, within two weeks from today. The authority concerned shall have the petitioner's answer sheet examined and in case no marks have been allotted, as per the decision taken by the respondents in respect of question nos. 20 and 31, then the authorities shall extend similar treatment to the petitioner and the petitioner's candidature would be dealt with accordingly. The required consideration would be made within a further period of two months, thereafter.
