The present writ petition has been filed against the orders passed by the consolidation authorities rejecting the claim of the petitioner for a single chak on Plot Nos. 202 and 201.
It is apparent from the order dated 17.1.2019 passed by the Settlement Officer of Consolidation that the petitioner has already been allotted two chaks on Plot Nos. 255 and 799 which were his original holding. The total area of Plot Nos. 201 and 202 is 0.962 hects. and the share of the petitioner along with his mother on the said plots was merely 1/6, i.e., 0.160 hects. In view of the aforesaid, the consolidation authorities rejected the claim of the petitioner on Plot Nos. 201 and 202. It is not the case of the petitioner that the petitioner has not been allotted a chak on his original holding or by the allotment of chaks, the petitioner has been deprived of the source of irrigation. The orders passed by the consolidation authorities do not violate any of the principles narrated in Section 19 of the Uttar Pradesh Consolidation of Holdings Act, 1953. The matter relates to allotment of chak and there can be no allotment of chak which would fully satisfy all the tenure holders of the village.
The writ petition lacks merit and is, hereby, dismissed.
