Heard Sri Arun Kumar Tiwari, learned counsel for the petitioner and Sri Rajesh Kumar, the learned Standing Counsel.
The grievance of the petitioner is that he is in possession of a part (0.840 hct) of gata no.1166 (area 0.1470 hct), but private respondent nos. 6 and 7 raised a kharanja over the same, even though the same is not recorded as chak marg in respect of which a police complaint was lodged on which the S.D.O concerned on 18.12.2017 directed the S.O, concerned that on the previous occasion the construction of kharanja was stopped but subsequently the same appears to have again constructed, parties were directed to ensure their presence alongwith records, but till date grievance of the petitioner has not been addressed.
The learned Standing Counsel submits that no useful purpose would be served by keeping the petition pending, it be disposed of by giving appropriate direction to the authority concerned.
This writ petition is disposed of with the direction to respondent no.4 to consider and dispose of the representation of the petitioner dated 18.12.2017 as expeditiously as possible after hearing the parties concerned to its logical conclusion, in accordance with law, preferably within 3 months from the date of production of certified copy of the order.
It is made clear that this court has not examined the merits of the contention of the petitioner.
Service of certified copy of this order upon the respondent concerned shall constitute sufficient notice upon him to submit a compliance report.
The authority concerned shall submit Compliance report in Chambers on 10.10.2018 at 4:00 P.M.
