1. Heard learned counsel for petitioner and learned standing counsel who appears on behalf of the State-respondents.
2. It has been submitted by the learned counsel for petitioner that he was initially engaged as a home-guard in 1998 and was allotted No. 2141 but since 2004 up to 2015 the petitioner has not been given any duty by his Company Commander Satya Veer who has also terminated him from service without assigning any reason. It is his allegation that Company Commander Satya Veer Singh was appointed in year 2011 and he used to take money from every home-guard for giving duty and when he demanded the illegal money from the petitioner, he opposed and denied to give the illegal gratification and then becoming annoyed he has terminated his services in 2015 itself.
3. The petitioner filed an application on 31.10.2015 and then again on 31.12.2016 to the higher authorities for revoking the termination order. Although a revocation of the termination order was asked by the Divisional Commandant Home Guard, Agra from the Company Commander Satya Veer Singh, yet no action has been taken thereafter.
4. The writ petition is disposed off without entering into the merits of the controversy with a direction to the Divisional Commandant, Home Guard, Agra, respondent No. 3, to look into the grievance of the petitioner. The petitioner shall submit a fresh representation along with a certificate copy of this order within a period two weeks from today. The Divisional Commandant, Home Guard, Agra shall take a decision himself or refer the matter to the competent authority who shall look into the grievance of the petitioner and shall take a decision on the representation of the petitioner within a period of eight weeks from the date such representation is made.
