Heard learned counsel for the petitioner as well as learned A.G.A. for the State-respondents.
The present petition has been filed by the father of the accused Karan and seeking direction to the respondent authorities to conduct fair investigation pursuant to the first information report registered as Case Crime no. 297 of 2019, under Sections 363, 328, 376, 506, 354, 452, 323 I.P.C and 3/4 of Protection of Children From Sexual Offences Act, 2012 Police Station Rakabganj District Agra.
The allegation in the writ petition is that the investigation of the case is being done in an absolutely tardy and unfair manner and instead of arresting the real accused the son of the petitioner is being harassed by the investigating officer. It is further submitted that inspite of several request of the petitioner the investigating officer is not paying any heed to his request.
Without expressing any opinion on the merits of the FIR, this writ petition is, therefore, disposed of with a direction to the opposite parties No. 2 and 3 to ensure a fair and proper investigation in the aforesaid First Information Report and conclude the same preferably within a period of six months from the date of production of certified copy of this order.
