Heard Sri Ashok Kumar Mishra, learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on the record.
Applicant-Vijendra Kumar Maurya seeks bail in Case Crime No.1094 of 2015, under Sections 498-A, 304-B I.P.C. and 3/4 of Dowry Prohibition Act, Police Station Robertsganj, District Sonebhadra.
Having heard learned counsel for the applicant, learned A.G.A. and perused the record including dying declaration of the deceased recorded on the same day when she sustained injuries on 22.10.2015 by Additional City Magistrate, III, Sonebhadra. The deceased had specifically stated that her husband and mother-in-law poured kerosene oil on her and set her on fire.
In the facts and circumstances of the case and also that there is specific allegation against the applicant, I do not find any ground to consider the prayer for bail of the applicant. The prayer for bail is declined at this stage.
The application for bail is, hereby, rejected without expressing any opinion on the merit of the case.
