Petitioner and Smt. Shalini Saxena, both, were placed under suspension and were sent to different institutions.
By an order passed today in Writ Petition No.8883 of 2018 filed by Smt. Shalini Saxena, the suspension order passed against her has been quashed with the direction to conclude the enquiry proceedings, within a period of four months.
Sri A.K. Yadav, appearing for the District Basic Education Officer, Mathura, states that similar orders may be passed in the present matter also, particularly as the suspension order has otherwise been stayed by this Court.
In the facts and circumstances, this writ petition is also disposed of by providing as under:-
(i). Order of suspension passed against the petitioner on 7.3.2018 stands quashed.
(ii). It shall be open for the respondents to conclude the disciplinary enquiry initiated against the petitioner, within a period of four month from the date of presentation of certified copy of this order.
(iii). Petitioner undertakes to submit a reply within two weeks from today, and also to cooperate in the enquiry proceedings.
(v). After conclusion of the enquiry, it shall be open for the respondents to pass a fresh order, in accordance with law.
