Vijaysinh vs Ns

High Court Of Gujarat|28 June, 2012

JUDGMENT / ORDER

1. This matter was called out in the morning. Mr. G. M. Joshi, learned Advocate for the petitioner was present. Learned Assistant Government Pleader was not present. Therefore, the matter was kept for second round. In the second round, learned AGP is not present. Therefore, I have heard Mr. G. M. Joshi on merits.
2. Mr. Joshi pointed out that there is no dispute on the fact that the petitioner was working as electrician and not as helper wireman. On the face of this undisputed position, it is contended by Mr. Joshi that the petitioner was entitled to pay-scale of Rs.1350-2200, however, since the present petition is restricted only to the challenge to withdrawal of pay-scale of Rs.1200-2040, it would not be within scope of this petition to contend for the petitioner that the Court may direct the respondent authority to grant pay-scale of Rs.1350-2200 to the petitioner. Learned Advocate Mr. Joshi has drawn attention of this Court to the averment of the petitioner, which reads as under, "....In view of the above my pay-scales ought to have been fixed at Rs.1350-2200, but it was fixed at Rs.1200-2040, which by itself was unjust, but having accepted the same, I am not making any grievance against the same."
3. I have perused the affidavit-in-reply as well as the affidavit-in-rejoinder, so also perused further affidavit dated 10.05.2010 filed by petitioner, which is on record.
4. Prima-facie, the relief as prayed for in the petition, deserves to be granted, however, to see to it that the Government is not deprived of its contest, the matter is adjourned to 29.06.2012.
