By way of this application, the applicant has prayed for restoration of the main writ petition being Special Civil Application (Stamp) No.15412 of 2008, which stood dismissed because of non-removal of the office objections vide order dated 25.02.2009.
Heard Mr.Shah, learned advocate for the applicant and Mr.Hasurkar, learned advocate for the opponent.
From the averments made in the application it appears that the applicant could not remove the office objections within time granted by this Court vide order dated 25.02.2009. Mr.Shah, learned advocate for the applicant, makes a statement that the applicant shall remove all the office objections if some time is granted.
Considering the averments made in the application as well as the assurance given by the learned advocate for the applicant, on the condition that the applicant shall remove all the office objections on or before 17.02.2012 the main writ petition being Special Civil Application (Stamp) No.15412 of 2008 is restored to file.
The application is allowed to the aforesaid extent. RULE made absolute accordingly. There shall be no order as to costs.
