This application is filed praying for deletion/modification of condition no.4(h) of order dated 22.3.2011 passed in Criminal Miscellaneous Application No.3564 of 2011.
Heard learned advocate for the applicant and learned APP for the State. He submits that the passport is due to expire on 15.1.2014 and that round about two to three months time is required for the procedure of renewing the same. He, therefore, prayed to allow this application and hand over the passport for renewal of the same.
Considering the averments made in the application, submissions made by learned advocates and the fact that no breach of condition is committed since the release of the applicant and no untoward incident is reported since his release, this application is allowed. Condition no.4(h) of order dated 22.3.2011 passed in Criminal Miscellaneous Application No.3564 of 2011 is suspended till 31.12.2013. The Additional Police Commissioner, Ahmedabad city is hereby directed to hand over the passport to the applicant for renewal purpose after due verification. On renewal of the passport, the applicant is directed to re-surrender the same to the Police Commissioner Office.
Rule is made absolute. Direct service is permitted.
